Member Agreement

Elder Law College is an organization dedicated to the advancement of lawyers in the fields of Estate Planning, Special Needs and Elder Law. This Agreement is between you, a member or prospective member, and Elder Law College, LLC., a Wyoming corporation with its headquarters in Florida. The purpose of this Agreement is to set forth (1) intellectual property rights; (2) a likeness release; (3) Data Collection and other matters related to your use of the Elder Law College Member Portal and other programs and resources. When you click accept at the bottom of this document, you are certifying that you have read this Agreement and that you agree to the terms hereof. License of Intellectual Property

I (hereinafter referred to as “Licensee”) am hereby granted a limited, non-assignable, non-exclusive license to the use of certain documents and materials provided by Elder Law College (hereinafter referred to as “Licensor”), for the business use of Licensee subject to the following: This license extends to all documents, visual materials, audio materials, articles and other written and/or electronic original work generated and/or owned by Licensor (hereinafter collectively referred to as “Works”) delivered by Licensor to Licensee through the Elder Law College Member Portal. This license is non-assignable by Licensee and is only for Licensee’s personal use. Licensee is authorized to use the Works only for the purpose of representing clients as an attorney and for speeches, marketing or other business development efforts for the Licensee’s law practice. Licensee may use any Works in speeches, marketing or other business development efforts for licensee’s own law practice for so long as Licensee remains a member of Elder Law College or, should the Works be legal forms for use in representing clients, then for so long as Licensee is licensed to practice law whether or not Licensee is a member of Elder Law College but so long as at least one year of membership was completed in good-standing. Works that are not legal forms used in direct representation of clients, must have attribution to “Elder Law College” in a font no smaller than one point less than the average font size used in the materials in question. To the extent any materials submitted by Licensor to Licensee are credited to someone other than Licensor or co-credited with Licensor, Licensee agrees to include proper attribution to that author and/or creator after getting any necessary permissions from that creator. Licensee agrees to not transmit or share any of the Works with any other person, firm, company or other entity outside of the law firm in which Licensee is employed in the active practice of law whether now or in the future and then only for the personal use of Licensee. Should you post any content, share or post other works or participate in a program with Elder Law College, you grant Elder Law College a non-exclusive license to use such content or other works forever and wherever and for whatever reason Elder Law College determines to be in the best interest of forwarding the interests of the organization. It is understood and agreed that nothing in the Works or other communications should be seen as rendering legal advice by Licensor to Licensee or any other person. Elder Law College is not a law firm and does not render legal advice. No member, faculty or other employee shall be seen as rendering legal advice through Elder Law College nor individually, unless by written representation agreement. No attorney-client relationship is intended or permitted between Licensor and Licensee or the clients, people and/or entities served by Licensee. Licensee agrees to use its best efforts to protect and safeguard the Works from unauthorized disclosure. Elder Law College may revoke this limited license at any time and for any reason. This Agreement is effective upon accepting the terms and conditions.

Likeness Release

Meetings and webinars are often recorded by video, audio and/or photography. Elder Law College uses these recordings and photographs for a number of reasons. We use such media to add content to the Member Portal, to promote the organization, to enhance member profiles and other uses which advance the organization. You hereby authorize Elder Law College to use photographs, videos and other media which may contain your image and/or voice if provided by you to Elder Law College or if generated or collected in connection with Elder Law College activities. You may withdraw your agreement to use your likeness prior to an event and Elder Law College will respond with whether this is possible so that you can decide whether to participate or not. Once you participate without an agreement to exempt your likeness, Elder Law College may deploy such media and your consent is therefore irrevocable.

Data Collection

How we collect personal and non-personal data

  • We may collect both personal data and non-personal data from individuals who visit our websites, use our products or services, or otherwise interact with us. This is sometimes done due to website protocols, widgets and other technologies which enable use of all of the features of our website including the ELC Member Portal. Personal data means information that can reasonably be connected to a specific individual. Non-personal data means information that cannot reasonably be connected to a specific individual.
  • We collect personal data from individuals who voluntarily provide such information. For example, we collect personal data including, but not limited to, names and contact information that individuals provide to us when registering for a program, using ELC services, member profile pages, purchasing, providing feedback about, or inquiring about our products or services. This information typically includes the individual’s name, title, name of company or organization, law school, year of graduation, Bar status and contact information including email addresses. When payment is submitted, we use an authorized third-party provider to collect and process payment information in a reasonably secure manner.
  • We also collect personal data from our members and other organizations about third parties. For example, our members may nominate candidates for participation in ELC. Other organizations may provide us with contact information for individuals interested in collaborating with us or our members, using our products or services, or attending an ELC event or training program. Our members and these organizations are responsible to ensure that they have any necessary consent before providing us with personal data belonging to a third party.
  • Additionally, we automatically collect personal data from users who visit any of our online resources, including our websites and mobile apps. For example, we may automatically collect visitors’ Internet Protocol (IP) addresses, the general location where the user’s computer is accessing the Internet, browser type, operating system, device type, and pages viewed.
  • We also automatically collect non-personal data from visitors to our website and users of our online services, such as the average time spent on our website, number of pages viewed, information that visitors search for, and other relevant statistics. We may also collect non-personal data through offline means, such as anonymous surveys.

Can other companies collect information from individuals who use our websites and other online services?

In many cases, yes. We work with companies to assist in running certain aspects of our online services that require collection of personal data. For example, we work with other companies to process credit card transactions, do direct email campaigns to members and non-members, help us run surveys, and other services and these companies may collect personal data directly from users. You should carefully review the privacy statement for each product you use to determine how these third parties will use the data they collect.

Additionally, third-party companies that offer website analytics and application monitoring tools to us may gather personal and non-personal data from visitors to our websites and online services, including by using cookies. These companies may use information collected from visitors over time and across third-party websites and online services. For more information, see our cookie notice below.

Collection of data from children

We have not designed our website or any other of our online services or products for use by children, particularly young children, and do not knowingly collect personal data from young children under 16. If you are a minor under the age of 16 and have used any of our online services or products (or you are the parent of a minor under the age of 16 who has used any of our online services or products), please contact us at nestrada@elderlawcollege.com so that we may undertake reasonable efforts to remove your (or your child’s) personal data from our systems.

Limiting the personal data we collect

Individuals have choices when it comes to the data they share with ELC. When we ask individuals to provide personal data, they can decline. In some instances, the use or function of a product or service may require some personal data; if you decline to provide personal data in those circumstances, you may be unable to use a product or service. In other instances, we need to collect personal data by law or to enter into or carry out a contract with you; if you do not provide the data, we will not be able to enter into the contract. Our cookie notice describes how you can limit what personal data we collect through automatic means.

Our Cookie Notice

We automatically collect personal and non-personal data from visitors to our websites and users of our online service by using automated technologies, including cookies. “Cookies” are small text files that a website saves on a computer or mobile device when an individual visits a website. Cookies assist us in enhancing a user’s experience when visiting any of our websites or using our online services. They also help us understand how people use our sites and services, so that we can better serve our members and users.

We, or third-parties on our behalf, also use data analytics tools, including Google Analytics, to provide us with personal data about your use of our websites and online services. These companies may use information collected from visitors over time and across websites and online services. Learn more about the privacy practices of Google Analytics on that company’s website.

You may configure your internet browser to reject cookies. However, this may affect your ability to effectively use our website and online services. Certain functionality is dependent upon the use of cookies. Our site is not configured to recognize “do not track” signals.

If you would like to learn more about cookies and other tracking technologies, and what you can do to limit organizations’ ability to track you online, the U.S. Federal Trade Commission has published a consumer guide that may be of interest.

Data Use and Disclosure

How we use personal and non-personal data

  • We use personal data to run our organization and to serve our members and program participants. For example, we use personal data to respond to member and event participant inquiries; determine organizational priorities; and provide information about ELC events and services, as well as public policy issues affecting our members. Additionally, we use personal data to improve our website and other online services, and to help us figure out ways to improve our events, products, and services.
  • We may also use or disclose personal data to detect, prevent, or otherwise address fraudulent, malicious, or damaging use of any of our systems, services, products, or property; to the extent allowable by law in an emergency or where necessary to protect public safety; or as required by law.
  • We use non-personal data for a variety of purposes. For example, we may use aggregated and anonymized data to improve our websites, understand our visitors’ needs, and administer websites and online services. We reserve the right to use and disclose non-personal data for any lawful purpose.

How we share personal and non-personal data

  • Elder Law College leverages its position and scale to bring opportunities to members they may not otherwise learn about or to obtain discounts and other benefits. Elder Law College also seeks out and is open to relationships that strengthen the organization. Unless you direct otherwise, Elder Law College may disclose your data to third parties to allow other organizations or companies to market their own products or services to you or to otherwise advance the organization’s position. We may work with other organizations—such as event planning companies or software companies—who use or store personal data on our behalf, so that we can run our organization or better serve our members and program participants. We also occasionally share personal data with other organizations who work with ELC on projects. For example, ELC has business relationships with certain technology, marketing or law practice organizations to conduct joint marketing and venture opportunities of interest to each organization’s members. These relationships are designed to strengthen the offerings and success of ELC and its members. For example, some organizations may provide discounts to our members and may need to verify membership status before extending that discount or notify you of that opportunity. You authorize ELC to share information with whatever organizations Elder Law College deems appropriate. You may elect not to be included in these opportunities and to opt out of Elder Law College sharing your data with others. To exercise this right, contact nestrada@elderlawcollege.com. You may exercise this option at any time, but doing so will necessarily alter Elder Law College’s ability to provide you with these services.
  • We may also disclose personal data (i) to the extent allowable by applicable law, in order to detect, prevent or otherwise address fraudulent, malicious or damaging use of any of our systems, services, products or property, (ii) to the extent allowable by applicable law, in an emergency or where necessary to protect public safety and (iii) as required by law, such as in response to a valid warrant or subpoena.
  • We occasionally provide non-personal data to other organizations, primarily for research purposes. However, we reserve the right to share non-personal data with third parties whenever allowable by applicable law.

How we secure personal data

  • We are committed to protecting the security of personal data. We use reasonable security technologies and procedures to protect users’ personal data from unauthorized access, use, alteration, or disclosure and from accidental loss or corruption. We require any third parties to whom we disclose personal data to also agree to employ reasonable security measures to protect personal data. We do not check the systems of any third parties to ensure compliance.

Your privacy is important to us as is the privacy of the information we share with you. That said, no system can guarantee absolute security. If we discover a data security incident affecting personal data that we have collected, we will notify affected individuals at least to the extent required by law.

Our data retention policy

We retain personal data for as long as is reasonably necessary to fulfil an individual’s request, as long as is reasonably necessary for a legitimate organizational interest of ours, or as long as you provide continued consent to our retention of your personal data. Location of data

We are a U.S.-based organization, with our headquarters in Florida. We store personal data on our servers or the servers of trusted service providers who use or store personal data on our behalf. We may export personal data from the United States in any manner allowable by law and consistent with this Privacy Policy.

Cancellation Charge

Please note that you may cancel your membership at any time following your membership term as described below. If you need to cancel a charge, a 2% charge will apply to canceled credit card transactions.

Text Messaging (SMS) Terms

These Text Messaging Terms apply to the SMS program operated by Elder Law College, LLC (“Elder Law College,” “ELC,” “we,” “us,” or “our”).

Program description. When you opt in, Elder Law College may send you text messages such as:

  • event and seminar date reminders;
  • registration confirmations;
  • program and event updates; and
  • replies to questions or requests you send us.

How to opt in. You can opt in by submitting your mobile number through a form or chat widget on our website or through any other means. Your provision of your mobile number to Elder Law College acts as your consent to receive text messages. By providing a mobile number associated with your name, you confirm that you are the account holder or have authorization to use the number provided.

Message frequency. Message frequency varies.

Cost. Message and data rates may apply, depending on your mobile carrier and plan.

Opt out. You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a confirmation message and then stop sending messages. If you want to rejoin, you can opt in again as described above. For WhatsApp or other services’ messages, you agree to receive invitations and texts from WhatsApp groups created by Elder Law College or its partner organizations just as you retain the right to leave any such group at any time.

Carriers. Mobile carriers and Elder Law College are not liable for delayed or undelivered messages through SMS or other messaging services.

The Elder Law College 360° Elder Law Practice Builder Program

The Elder Law College 360° Elder Law Practice Builder Program has a fee charged for enrollment in the program plus payments for the twelve months following enrollment. One year of membership in Elder Law College is included in your registration for that program with full benefits of Elder Law College membership. This comes with your responsibilities to honor the licensure and other agreements in this Agreement and to pay the agreed enrollment fee and monthly payments. To see the benefits of Elder Law College, click here. Specific benefits change from time to time. Registrants for the Elder Law College 360° Practice Builder program, once fully paid, gain access to the Member Portal but are not considered Members of Elder Law College until completion of the program. While you can cancel your membership at any time, compensation for the course requires payment of the registration fee plus the twelve monthly payments (or equivalent amount in one lump sum), regardless of membership status. By accepting these terms and conditions, I hereby authorize all charges or withdrawals to be made to the credit card or account I have furnished to Elder Law College including: (1) registration for the 360 program in the amount for which I have registered and (2) monthly charges or withdrawals beginning the month after registration for the Elder Law College 360° Practice Builder Program. I understand that monthly charges will continue automatically for the membership category for which I have registered until twelve months of payments have been made or until I cancel whichever is later. Members have the option to remain members for so long as they wish until and unless terminated by the Member or by Elder Law College. Cancellation is effective for the calendar month following notice of cancellation.

Fees and Costs of Membership, Cancellation and Reinstatement Fee

All membership categories carry a one-year minimum term and are billed at the agreed-upon amounts. Cancellation may occur after one year of payments and is effective the month following notice. Notice must be given at least 10 business days prior to the end of the term of membership to allow for processing. If I wish to discontinue my membership, I will notify the Elder Law College Accounting Department at account@elderlawcollege.com of my wish to cancel. Cancellation is effective after the current membership term is over. The remaining term of membership is still valid for the Member’s use until the end of the current term of membership. For example, if the term of membership is month to month, as it is for all members who do not elect a longer term, notice must be given within ten days prior to the next month to cancel for that following month. Elder Law College will promptly cancel membership. The individual’s membership would still be active for the remainder of the month in which the cancellation notice was sent and membership would cease the following month.

Credit Card Authorization

I authorize Elder Law College, LLC to use the credit card information provided for Elder Law College Transactions, including Registration for any selected program(s) and Monthly Membership Fees. If I have selected a term other than monthly, I authorize Elder Law College to bill on that term instead. Elder Law College will not charge your credit card without authorization from you.

If I wish to discontinue my membership, I will notify the Elder Law College Accounting Department at account@elderlawcollege.com of my wish to do so.

Updates

We reserve the right to amend this Privacy Policy and Cookie Notice at any time, for any reason allowable by applicable law. We will post any new Privacy Policy and/or Cookie Notice on the Elder Law College Member Portal, and we will provide a prominent disclosure on our Member Portal, accessible at www.elderlawcollege.com, if we implement changes to our Privacy Policy and/or Cookie Notice that will result in materially less protection for personal data collected after the effective date of the new policy. We will keep that notice on the Member Portal for at least thirty days after implementation of the new policy. It is your responsibility to login to the Member Portal to see such changes. Your continued use of the Member Portal and other Elder Law College resources is your consent to changes If you do not agree to the changes, do not continue to use the Member Portal or other Elder Law College resources. We will not use or disclose personal data we collected pursuant to this version or an earlier version of our Privacy Policy in a manner that is materially less protective than this version of our Privacy Policy without first publishing changes as detailed above.
