Your Membership Will Include: Tickets and attendance to the 3-day intensive 360° Elder Law Practice Builder Conference in Las Vegas, and following attendance, you will gain full access to the ELC Student Portal which includes online courses and tutorials, the ELC Document Library (every document you will need as an Elder Law attorney, updated and revised on a continual basis), access to other students and ongoing ELC community support, 1-on-1 time with lead instructor Scott Solkoff, and guidance on marketing and new client generation.

Today you are making a deposit of $225 to reserve your seat. The final balance of $2,025 will be due and payable no later than January 7th (45 days prior to the beginning of the program). Post-seminar billing is $150.00 per month, for a total investment over 1 year of $4,050. If you cancel your attendance with 60 or more days until the seminar, half of your deposit will be refunded. If cancellation takes place less than 60 days until the seminar, your deposit is non-refundable.

Terms and Conditions

Member Agreement   Elder Law College is an organization dedicated to the advancement of lawyers in the fields of Special Needs and Elder Law. This Agreement is between you, a member or prospective member, and Elder Law College, LLC., a Wyoming corporation with its headquarters in Florida. The purpose of this Agreement is to set forth (1) intellectual property rights; (2) limitations on liability; (3) a likeness release; (4) the privacy policy of Elder Law College; (5) fees and costs of membership and (6) at the end of this document, your credit card authorization if you are registering for a program, are a member or are registering to become a member. When you click accept at the bottom of this document, you are certifying that you have read this Agreement and that you agree to the terms hereof.   1. License of Intellectual Property
  I (hereinafter referred to as “Licensee”) am hereby granted a limited, non-assignable, non-exclusive license to the use of certain documents and materials provided by Elder Law College (hereinafter referred to as “Licensor”), for the business use of Licensee subject to the following: This license extends to all documents, visual materials, audio materials, articles and other written and/or electronic original work generated and/or owned by Licensor (hereinafter collectively referred to as “Works”) delivered by Licensor to Licensee through the Elder Law College Member Portal. This license is non-assignable by Licensee. Licensee is authorized to use the Works only for the purpose of representing clients as an attorney and for speeches, marketing or other business development efforts. Licensee may use any Works in speeches, marketing or other business development efforts for licensee’s own law practice for so long as Licensee remains a member of Elder Law College or, should the Works be legal forms for use in representing clients, then for so long as Licensee is licensed to practice law whether or not Licensee is a member of Elder Law College but so long as at least one year of membership was completed in good-standing. Works that are not legal forms used in direct representation of clients, must have attribution to “Elder Law College” in a font no smaller than one point less than the average font size used in the materials in question. To the extent any materials submitted by Licensor to Licensee are credited to someone other than Licensor or co-credited with Licensor, Licensee agrees to include proper attribution to that author and/or creator after getting any necessary permissions from that creator.. Licensee agrees to not transmit or share any of the Works with any other person, firm, company or other entity outside of the law firm in which Licensee is employed in the active practice of law whether now or in the future. Should you post any content, share or post other works or participate in a program with Elder Law College, you grant Elder Law College a non-exclusive license to use such content or other works forever and wherever and for whatever reason Elder Law College determines to be in the best interest of forwarding the interests of the organization. It is understood and agreed that nothing in the Works or other communications should be seen as rendering legal advice by Licensor to Licensee or any other person. Elder Law College is not a law firm and does not render legal advice. No member, faculty or other employee shall be seen as rendering legal advice through Elder Law College nor individually, unless by written representation agreement. No attorney-client relationship is intended or permitted between Licensor and Licensee or the clients, people and/or entities served by Licensee. Licensee agrees to use its best efforts to protect and safeguard the Works from unauthorized disclosure. Elder Law College may revoke this limited license at any time and for any reason. This Agreement is effective upon accepting the terms and conditions.  
  1. Likeness Release
  This conference is being videotaped and photographed. Elder Law College uses photographs and video for a number of reasons. We use such media to add content to the Member Portal, to promote the organization, to enhance member profiles and other uses which advance the organization. You hereby authorize Elder Law College to use photographs, videos and other media which may contain your image and/or voice if provided by you to Elder Law College or if generated or collected in connection with Elder Law College activities.  
  1. Privacy Policy and Cookie Notice
  Elder Law College is committed to protecting individuals’ privacy while fulfilling its mission to educate attorneys and provide resources on matters affecting the law, the elderly, people with disabilities, their families and their caregivers. This policy describes how we collect, use, disclose, and protect personal and non-personal data relating to our members, program participants, website visitors and other individuals who interact with us.  
  1. Scope
  This policy applies to Elder Law College along with any subdivisions and sibling organizations whether now existing or hereafter created. When we mean Elder Law College, we may sometimes refer to it as “ELC.”   Please note that this Privacy Policy and Cookie Notice does not cover third-party websites or applications. If you interact with us using a third-party website or application, such as a social media platform, or use our services through a third-party website or application, such as by using another organization’s listserv or website, you will share data with the third party in accordance with the third party’s privacy policy. The third party can use or share the data it receives according to its own practices and policies. We strongly encourage you to review the privacy notice published by any third party before using its websites or applications. Some links on the ELC website may take you to third-party websites or resources in which case that third party can use or share the data it receives according to its own practices and policies.  
  1. Data Collection
  How we collect personal and non-personal data
  • We may collect both personal data and non-personal data from individuals who visit our websites, use our products or services, or otherwise interact with us. This is sometimes done due to website protocols, widgets and other technologies which enable use of all of the features of our website including the ELC Member Portal. Personal data means information that can reasonably be connected to a specific individual. Non-personal data means information that cannot reasonably be connected to a specific individual.
 
  • We collect personal data from individuals who voluntarily provide such information. For example, we collect personal data including, but not limited to, names and contact information that individuals provide to us when registering for a program, using ELC services, member profile pages, purchasing, providing feedback about, or inquiring about our products or services. This information typically includes the individual’s name, title, name of company or organization, law school, year of graduation, Bar status and contact information including email addresses. When payment is submitted, we use an authorized third-party provider to collect and process payment information in a reasonably secure manner. We do not store detailed credit card or check payment information on our systems.
 
  • We also collect personal data from our members and other organizations about third parties. For example, our members may nominate candidates for participation in ELC. Partner organizations may provide us with contact information for individuals interested in collaborating with us or our members, using our products or services, or attending an ELC event or training program. Our members and partner organizations should ensure that they have any necessary consent before providing us with personal data belonging to a third party.
 
  • Additionally, we automatically collect personal data from users who visit any of our online resources, including our websites and mobile apps. For example, we may automatically collect visitors’ Internet Protocol (IP) addresses, the general location where the user’s computer is accessing the Internet, browser type, operating system, device type, and pages viewed.
 
  • We also automatically collect non-personal data from visitors to our website and users of our online services, such as the average time spent on our website, number of pages viewed, information that visitors search for, and other relevant statistics. We may also collect non-personal data through offline means, such as anonymous surveys.
  Can other companies collect information from individuals who use our websites and other online services? In many cases, yes. We work with partner companies to assist in running certain aspects of our online services that require collection of personal data. For example, we work with other companies to process credit card transactions, do direct email campaigns to members and non-members, help us run surveys, and other services and these partners may collect personal data directly from users. You should carefully review the privacy statement for each product you use to determine how these third parties will use the data they collect.   Additionally, third-party companies that offer website analytics and application monitoring tools to us may gather personal and non-personal data from visitors to our websites and online services, including by using cookies. These companies may use information collected from visitors over time and across third-party websites and online services. For more information, see our cookie notice below.   Collection of data from children We have not designed our website or any other of our online services or products for use by children, particularly young children, and do not knowingly collect personal data from young children under 16. If you are a minor under the age of 16 and have used any of our online services or products (or you are the parent of a minor under the age of 16 who has used any of our online services or products), please contact us at nestrada@elderlawcollege.com so that we may undertake reasonable efforts to remove your (or your child’s) personal data from our systems.   Limiting the personal data we collect Individuals have choices when it comes to the data they share with ELC. When we ask individuals to provide personal data, they can decline. In some instances, the use or function of a product or service may require some personal data; if you decline to provide personal data in those circumstances, you may be unable to use a product or service. In other instances, we need to collect personal data by law or to enter into or carry out a contract with you; if you do not provide the data, we will not be able to enter into the contract. Our cookie notice describes how you can limit what personal data we collect through automatic means.   Our Cookie Notice We automatically collect personal and non-personal data from visitors to our websites and users of our online service by using automated technologies, including cookies. “Cookies” are small text files that a website saves on a computer or mobile device when an individual visits a website. Cookies assist us in enhancing a user’s experience when visiting any of our websites or using our online services. They also help us understand how people use our sites and services, so that we can better serve our members and users.   We, or third-parties on our behalf, also use data analytics tools, including Google Analytics, to provide us with personal data about your use of our websites and online services. These companies may use information collected from visitors over time and across websites and online services. Learn more about the privacy practices of Google Analytics on that company’s website.   You may configure your internet browser to reject cookies. However, this may affect your ability to effectively use our website and online services. Certain functionality is dependent upon the use of cookies. Our site is not configured to recognize “do not track” signals.   If you would like to learn more about cookies and other tracking technologies, and what you can do to limit organizations’ ability to track you online, the U.S. Federal Trade Commission has published a consumer guide that may be of interest.
  1. Data Use and Disclosure
  How we use personal and non-personal data
  • We use personal data to run our organization and to serve our members and program participants. For example, we use personal data to respond to member and event participant inquiries; determine organizational priorities; and provide information about ELC events and services, as well as public policy issues affecting our members. Additionally, we use personal data to improve our website and other online services, and to help us figure out ways to improve our events, products, and services.
 
  • We may also use personal data to detect, prevent, or otherwise address fraudulent, malicious, or damaging use of any of our systems, services, products, or property; to the extent allowable by law in an emergency or where necessary to protect public safety; or as required by law.
 
  • We use non-personal data for a variety of purposes. For example, we may use aggregated and anonymized data to improve our websites, understand our visitors’ needs, and administer websites and online services. We reserve the right to use and disclose non-personal data for any lawful purpose.
  How we share personal and non-personal data
  • We will not sell or otherwise disclose personal data to third parties for commercial gain or to allow other organizations or companies to market their own products or services to you without your consent. However, we may work with other organizations—such as event planning companies or software companies—who use or store personal data on our behalf, so that we can run our organization or better serve our members and program participants. We also occasionally share personal data with other organizations who partner with ELC on projects. For example, ELC has business relationships with certain technology, marketing or law practice organizations to conduct joint marketing and venture opportunities of interest to each organization's members. These relationships are designed to strengthen the offerings and success of ELC and its members. For example, some organizations may provide discounts to our members and may need to verify membership status before extending that discount. You authorize ELC to share information with the organizations listed on the ELC website or announced on the member listserv. Before disclosing personal data to any other organization not so announced, we will require the organization to agree to treat the information in a way that is consistent with this Privacy Policy and, where required by law, will obtain your prior consent.
 
  • We may also disclose personal data (i) to the extent allowable by applicable law, in order to detect, prevent or otherwise address fraudulent, malicious or damaging use of any of our systems, services, products or property, (ii) to the extent allowable by applicable law, in an emergency or where necessary to protect public safety and (iii) as required by law, such as in response to a valid warrant or subpoena.
 
  • We occasionally provide non-personal data to other organizations, primarily for research purposes. However, we reserve the right to share non-personal data with third parties whenever allowable by applicable law.
  How we secure personal data
  • We are committed to protecting the security of personal data. We use reasonable security technologies and procedures to protect users’ personal data from unauthorized access, use, alteration, or disclosure and from accidental loss or corruption. We require any third parties to whom we disclose personal data to also agree to employ reasonable security measures to protect personal data. We do not check the systems of any third parties to ensure compliance.
  Your privacy is important to us as is the privacy of the information we share with you. That said, no system can guarantee absolute security. If we discover a data security incident affecting personal data that we have collected, we will notify affected individuals at least to the extent required by law.   Our data retention policy We retain personal data for as long as is reasonably necessary to fulfil an individual’s request, as long as is reasonably necessary for a legitimate organizational interest of ours, or as long as you provide continued consent to our retention of your personal data. We store personal data on our servers or the servers of trusted service providers who use or store personal data on our behalf. We may export personal data from the United States in any manner allowable by law and consistent with this Privacy Policy.  
  1. Cancellation
Cancellation Charge Please note that a 2% charge will apply to cancellations. We regret that our providers will still require us to cover transaction costs for all registrations regardless of course completion.   Updates We reserve the right to amend this Privacy Policy and Cookie Notice at any time, for any reason allowable by applicable law. We will post any new Privacy Policy and/or Cookie Notice on our website, and we will provide a prominent disclosure on our homepage, www.elderlawcollege.com, if we implement changes to our Privacy Policy and/or Cookie Notice that will result in materially less protection for personal data collected after the effective date of the new policy. We will keep that notice on the homepage for at least thirty days after implementation of the new policy. We will not use or disclose personal data we collected pursuant to this version or an earlier version of our Privacy Policy in a manner that is materially less protective than this version of our Privacy Policy without first obtaining your consent.   Need further assistance?   1. Fees and Costs of Membership
  The Elder Law College 360° Elder Law Practice Builder Program is a prerequisite for most attorneys to enter Elder Law College. The program teaches essential Elder Law skills, ethics and law and helps to develop a shared philosophy and experience among members. There is a flat fee charged for enrollment in the program plus payments for the twelve months following enrollment. While you can cancel your membership at any time, compensation for the course requires payment of the registration fee plus the twelve monthly payments regardless of membership status.   Membership: Membership in Elder Law College is conditioned, for most attorneys, on completion of the Elder Law College 360° Elder Law Practice Builder Program. One year of membership in Elder Law College is included in your registration for that program with full benefits of Elder Law College membership. To see the benefits of Elder Law College, click here. Specific benefits change from time to time. Registrants for the Elder Law College 360° Practice Builder program, once fully paid, gain access to the Member Portal but are not considered Members of Elder Law College until completion of the program.
  1. Credit Card Authorization
  I authorize Elder Law College, LLC to use the credit card information provided for Elder Law College Transactions, including Registration and Monthly Membership Fees. Elder Law College will not charge your credit card without authorization from you.   By accepting these terms and conditions, I hereby authorize all charges to be made to the credit card I have furnished to Elder Law College including: (1) registration for the 360 program in the amount for which I have registered and (2) monthly charges beginning the month after registration for the Elder Law College 360° Practice Builder Program. I understand that monthly charges will continue automatically for the membership category for which I have registered until twelve months of payments have been made or until I cancel whichever is later. Cancellation is effective for the calendar month following notice of cancellation.   If I am an attorney for whom registration for the Elder Law College 360° Practice Builder Program has been waived, my authorization is to start the monthly payments for the membership category for which I registered immediately upon my registration. I will not be attending and will not be charged for the Elder Law College 360° Practice Builder Program.   If I wish to discontinue my membership, I will notify the Elder Law College Accounting Department account@elderlawcollege.com of my wish to do so and the monthly charges will stop that following month.
